Holder

Holder. The Lender and thereafter any Person who shall at the time be the registered holder of this Note

Holder. Shall mean a holder of restricted common shares of Caspian Services, Inc. purchased in the Private Placement or anyone to whom the registration rights conferred by this Agreement have been transferred in compliance with this Agreement.

Holder. A Consultant who holds an outstanding Warrant

Holder. Any Carlyle Holder, any Executive Holder and any Other Executive Investor.

Holder. Means the Person in whose name the Series A Preferred Shares are registered on the stock register of the Corporation maintained by the Registrar and Transfer Agent.

Holder. Any Person who is a party to this Agreement or any Assignee

Holder. Means any holder of Registrable Securities who is a party to this Agreement provided, however, that Gigamon Systems shall not be deemed a Holder for the purposes of Sections 2.1, 2.3(a), 2.3(c) or 2.10.

Holder. Means the Trustee, any successor to the Trustee appointed by the Court pursuant to a Plan of Liquidation or otherwise, any Affiliate of the DBSI Entities which is a holder of Registrable Securities, any permitted transferees of any of the foregoing, and any Person acquiring any of the Shares pursuant to the terms of the letter agreement with Roth accompanying the Lock-Up Agreement who agrees in writing to be bound by and subject to the terms and conditions of this Agreement.

Holder. The meaning set forth in the first paragraph of this Warrant following the restrictive legend and "Holders" means the holders of the Subscribed Securities, including Warrants
