Holders

Holders. Means the registered holders from time to time of Exchangeable Shares, other than Pubco and its Subsidiaries.

Holders. Shall mean the holders of Series C, D, E, F, G, H and I Securities and holders of Warrants, Extinguishing Warrants and Series H Warrants who are parties to this Agreement, and their assignees permitted in accordance with Section 12 hereof.

Holders. Means the original Holders of the Warrants issued pursuant to the Securities Purchase Agreement, or if any such original Holder so elects, any transferee of all or any portion of this Warrant whom such original Holder shall have designated by written notice to the Company. Any successor Holder designated pursuant to the immediately preceding sentence shall also have the right upon any subsequent transfer to designate a successor Holder in the manner described above.

Holders. Shall mean the Persons set forth on Exhibit A and executing a signature page hereto and any Person who shall have acquired Registrable Securities from a Holder as permitted herein, either individually or jointly as the case may be.

Holders. Means, as of any date of determination, the holders of Registrable Securities, provided that the rights of Transferees of the Holders shall be limited as provided in Section 8(h).

Holders. As defined in the introductory paragraph of this Agreement.

Holders. Any holder of outstanding Registrable Securities (as defined below) or anyone who holds outstanding Registrable Securities to whom the registration rights conferred by this Agreement have been transferred in compliance with this Agreement.

Holders. Means the Recap Parties, for so long as they own any Preferred Shares or Conversion Shares, and each of their successors, permitted assigns and direct and indirect permitted transferees who become holders of Preferred Shares or Conversion Shares.
