Payment Date

Payment Date. Means the sixtieth (60th) day following the earlier of (i) Executive's Termination Date or (ii) the Retention Date.

Payment Date. The tenth business day following effectiveness of the release of claims described in Section 4; provided however, if the 60th day following termination of employment falls in a subsequent calendar year, then the Payment Date shall be the later of (i) the first business day of such subsequent calendar year and (ii) the tenth business day following effectiveness of the release.
