Agreement

Agreement. Means the agreement, whether in written or electronic form, between the Company or an Affiliate and a Participant containing the terms and conditions of an Award (not inconsistent with this Plan), together with all amendments to such agreement, which amendments may be unilaterally made by the Company unless such amendments are deemed by the Committee to be materially adverse to the Participant or are not required as a matter of law. Agreement. And "this Agreement" shall mean this Joint Venture Agreement, including all Exhibits hereto and, except where the context otherwise clearly requires, all certificates, documents and instruments executed and/or delivered at or prior to Closing.

Agreement. Means this Agreement, as may be amended, including all Appendices and Exhibits attached hereto.

Agreement. As used in this Agreement means and includes this Loan & Security Agreement, any concurrent or subsequent rider to this Loan & Security Agreement, and any concurrent or subsequent extensions, supplements, amendments or modifications to this Loan & Security Agreement or to any such rider.

Agreement. Shall mean, and the words "herein," "hereof," "hereunder" and words of similar import shall refer, to this instrument and any amendment hereto.
