Agreement

Agreement. Means this Modification Agreement as supplemented or amended.

Agreement. Means this Non-Compete Agreement, including all Exhibits and Schedules hereto.

Agreement. Shall mean this Study Agreement between Merck and CMTI.

Agreement. Means this Supplemental Stockholders' Agreement, as the same may be modified, supplemented or amended from time to time in accordance with its terms.

Agreement. Has the meaning defined in the Preamble above.

Agreement. Means this Software License and Support Agreement, including its schedules, exhibits, and appendices, as the same may be amended by the Parties from time to time in accordance with Section 16.3.

Agreement. Section 2. Acknowledgment. Customer acknowledges that the financial covenants set forth in Attachment A to the Agreement are applicable to the financial results of Customer for the quarterly period ending October 31, 2002, and Customer was required to maintain such financial covenants at all times.

Agreement. Means this Agreement (sometimes referred to as "Agreement"), together with the schedules, exhibits, and other appendices, attached hereto or incorporated herein by reference.

Agreement. Shall have the meaning set forth in Recitals hereof.

Agreement. Means this Value Assurance Agreement, as it may be amended from time to time in accordance with its terms.
