Example Definitions of "Date of Termination"
Date of Termination. Shall mean (i) if Executive's employment is terminated due to Executive's death, the date of Executive's death; and (ii) if Executive's employment is terminated for any reason other than death, the date specified in the Notice of Termination.
Date of Termination. The date of receipt of the Notice of Termination or any later date specified therein, as the case may be. For all purposes of this Agreement, the Executive's Date of Termination shall not occur prior to the date the Executive incurs a "separation from service" within the meaning of Section 409A(a)(2)(A)(i) of the Code.
