Hazardous Material

Hazardous Material. Means any hazardous or toxic substance, material or waste, including petroleum products and including, but not limited to, those substances, materials, and wastes listed in the United States Department of Transportation hazardous materials Table (49 CFR 172.101) or by the Environmental Protection Agency as hazardous substances (40 CFR Part 302) or amendments thereto, and such substances, materials and wastes that are or become regulated under any applicable local, state or federal law.

Hazardous Material. Means (i) any substance or material regulated under applicable Environmental Laws or any other product, substance, pollutant, chemical, material or waste whose presence, nature, quantity and/or intensity of existence, use, manufacture, disposal, transportation, spill, Release or effect, either by itself or in combination with other materials used by the Business, is either potentially injurious to the public health, safety or welfare, or the environment, or (ii) could reasonably be expected to... provide a basis for liability of any of the Companies or to any Governmental Authority or other Person under any Applicable Environmental Law. Hazardous Material. Means any hazardous substance, toxic chemical, pollutant or other material which is or becomes regulated by the Comprehensive Environmental Response, Compensation and Liability Act of 1985 or the Minnesota Environmental Response and Liability Act or any similar law, regulation or code (local, state or federal), including without limitation petroleum and petroleum products and any material, equipment or machinery containing asbestos, polychlorinated biphenyls (PCB's), chlorofluorocarbons (CFC's)... or hydrofluorocarbons (HCFC's). Hazardous Material. Shall mean (a) materials which are listed or otherwise defined as "hazardous" or "toxic" under any applicable local, state, federal and/or foreign laws and 33 regulations that govern the existence and/or remedy of contamination on property, the protection of the environment from contamination, the control of hazardous wastes, or other activities involving hazardous substances, including building materials, or (b) any petroleum products or nuclear materials.

Hazardous Material. A material that, if it is released into the environment, Applicable Laws require the owner or operator of the property at which such release occurred to remedy the effect on the environment of such release.

Hazardous Material. Means, collectively (A) any hazardous or toxic substance, material or waste, including, but not limited to, those substances, materials, and wastes listed in the United States Department of Transportation Hazardous Materials Table (49 CFR 172.101) or by the Environmental Protection Agency as hazardous substances (40 CFR Part 302) and amendments thereto and replacements therefor; (B) such substances, materials or wastes as are regulated by the Resource Conservation and Recovery Act of 1976, 42... U.S.C. §6901 et. seq. ("RCRA"), the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended by the Superfund Amendments and Liability Act, 42 U.S.C. §9601 et. seq. ("CERCLA"), the Toxic Substance Control Act, 15 U.S.C. §2601 et seq. ("TSCA"), the Clean Air Act, 42 U.S.C. §7401 et seq. ("CAA"), the Clean Water Act, 33 U.S.C §1251 et. seq. ("CWA"), or any substance that is a "hazardous substance" or "hazardous waste" under the New Jersey Spill Compensation and Control Act, the New Jersey Industrial Site Recovery Act or the New Jersey Solid Waste Management Act or N.J.A.C. 7:26C-1.3, and all amendments to any of the foregoing laws, and all orders, regulations, directions and requirements thereunder; (C) asbestos; (D) such toxic or hazardous substances, materials or wastes that are or may become regulated under any other applicable municipal, county, state or federal law, rule, ordinance, direction, or regulation; and (E) any other substance or material regulated under any applicable municipal, county, state or federal law, rule, ordinance, direction, or regulation because of its dangerous or deleterious effects on human health or the environment. Hazardous Material. Any material which is or becomes regulated by any applicable governmental authority, or any other hazardous or toxic material.

Hazardous Material. Hazardous Material. Hazardous Material. Shall mean any hazardous material, hazardous waste, hazardous substance, hazardous constituent, toxic substance, pollutant, contaminant, asbestos, petroleum, petroleum waste, radioactive material, biohazardous material, explosive or any other material, the presence of which in the environment is prohibited, regulated, or serves as the basis of liability, as defined, listed, or regulated by any applicable federal, state, or local environmental law, ordinance, rule, or regulation.
