Holder

Holder. Each Investor, and all persons or entities to whom the rights granted under this Agreement are transferred by such Investor or his or her successors or assigns pursuant to Section [16] hereof.

Holder. Includes subsequent permitted holders of this Note.

Holder. The terms "Borrower" and "Holder" and other nouns and pronouns include the singular and/or the plural, as appropriate. The terms "Borrower" and "Holder" also include their respective heirs, personal representatives, permitted successors and assigns. The term "Holder" includes subsequent permitted holders of this Debenture.

Holder. Has the meaning set forth in the New Indenture.

Holder. Means each Purchaser holding PIPE Shares, each holder of VHS Shares and each holder of Conversion Shares.

Holder. David M. Smith and any Affiliate or permitted transferee of David M. Smith who is a subsequent holder of any Registrable Securities.

Holder. Shall mean , or any person or entity to whom it has assigned its rights hereunder pursuant to the terms hereof and in whose name this Warrant shall be registered upon the books to be maintained by the Company for that purpose.

Holder. Shall mean the Person in whose name a Warrant is registered in the warrant register of the Company maintained by or on behalf of the Company for such purpose. 1

Holder. Means the holders of Registrable Shares who are parties to this Agreement, including but not limited to Investor, or successors or assigns or subsequent holders contemplated by Section 14 hereof.

Holder. Means ASYM Energy Opportunities LLC or its assigns.
