Securities

Securities. Means the Common Stock and any options to acquire the Common Stock beneficially owned by Minority Holders.

Securities. Means all if the Common Stock, convertible securities, options, warrants, or other rights to acquire securities of the Company on a fully diluted basis.

Securities. Shall mean, collectively, the 7 7/8% Senior Subordinated Notes due 2014 of the Company to be issued and sold to the Purchasers, and securities issued in exchange therefor or in lieu thereof pursuant to the Indenture provided that the Securities do not include the Exchange Securities.

Securities. Shall mean any and all shares of Common Stock received by each Purchaser under the Merger Agreement, whether constituting Merger Stock or Additional Merger Stock, as defined therein.

Securities. Shall mean the Shares and the Common Stock issued or issuable upon the conversion of the Shares.

Securities. Any mortgage pass-through certificates or other securities evidencing a beneficial interest in a rated or unrated public offering or private placement related to a commercial mortgage securitization transaction.
