Warrant(s)

Warrant(s). Shall mean the warrants, dated as of the date hereof, issued by the Company to the holders of the Notes pursuant to the Purchase Agreement.

Warrant(s). Means the warrants or other convertible securities issued to the Investor in connection with the Qualifying Proposal.

Warrant(s). (i) the warrants to purchase shares of the Common Stock issued pursuant to the Warrant Agreement and any warrants issued in exchange, substitution or replacement thereof and (ii) the warrants to purchase shares of the Common Stock issued pursuant to the Warrant Agreement, dated as of March 29, 2005, as amended from time to time, between the Company and Mellon Investor Services LLC, as warrant agent thereunder, and any warrants issued in exchange, substitution or replacement therefor.

Warrant(s). Shall mean the collective reference to the Class A Warrants, the Class B Warrants, and the Placement Agent Warrants.
