Agent

Agent. BTIG, LLC, Citizens JMP Securities, LLC, Goldman Sachs & Co. LLC, J.P. Morgan Securities LLC, Wells Fargo Securities, LLC

Agent. For the purposes of this Agreement, "Agent" means any person who is a director or officer of the Company; or is serving at the request of, for the convenience of or to represent the interests of the Company as a director, officer, manager, employee or agent of another foreign or domestic corporation (for profit or nonprofit), partnership, limited liability company, joint venture, trust or other enterprise (specifically including employee benefit plans).

Agent. Shall mean Merrill Lynch Capital, a division of Merrill Lynch Business Financial Services, Inc., as Administrative Agent for the Senior Lenders, or any other Person appointed by the holders of the Senior Debt as successor administrative agent for purposes of the Senior Debt Documents and this Agreement.

Agent. For the purposes of this Agreement, "agent" of PNCL means any person who is or was a director, officer, employee or other agent of PNCL or a subsidiary of PNCL; or is or was serving at the request of, for the convenience of or to represent the interest of PNCL or a subsidiary of PNCL as a director, officer, employee or agent of another foreign or domestic corporation, partnership, joint venture, trust or other enterprise.

Agent. First Chicago Trust Corporation of New York or any other entity designated by the Plan Administrator to act as its administrative service provider.

Agent. Shall have the meaning given to that term in the introductory paragraph hereof.

Agent. As used in this Agreement, the terms "Agent", "Agreement", "Borrower", and "Loan Agreement" shall have the meanings indicated above.

Agent. Shall mean a representative of Xpeed's products to customers in the Territory.

Agent. Omicron Master Trust in its capacity as a Lender and on behalf of the other Lender.

Agent. The term "Agent" of the Company shall mean and include any person who is or was a director, officer, employee or other agent of the Company or is or was serving at the request of the Company as a director, officer, employee or agent of another foreign or domestic corporation, partnership, joint venture, trust or other enterprise (including any employee benefit plan), or was a director, officer, employee or agent of a predecessor corporation of the Company.
