Confidential Information. The following: (i) materials, records, documents, data, statistics, studies, plans, writings, and information (whether in handwritten, printed, digital, or electronic form) relating to the Employer's Business (as defined below) that are not generally known or available to the Employer's Business, trade, or industry or to individuals who work therein other than through a breach of this Agreement, or (ii) trade secrets of the Employer (as defined under applicable law). Confidential Information. Means all non-public materials, information and data concerning the disclosing party and its operations that is disclosed by the disclosing party to the receiving party pursuant to this Agreement, orally or in written, electronic or tangible form, or otherwise obtained by the receiving party through observation or examination of the disclosing party's operations. Confidential Information.
