Contract Year

Contract Year. Shall mean a period, with respect to the first Contract Year only, starting on the Effective Date and ending on March 31, 2007 and then each successive period of twelve (12) consecutive calendar months commencing on April 1 and ending on March 31 of the following year. 2

Contract Year. Shall mean the specific period of time during the Contract Period as more specifically set forth below: · Contract Year 2011 (2/21/11 - 12/31/11) · Contract Year 2012 (1/1/12- 12/31/12)

Contract Year. Means an annual period from (a) the Commencement Date or an anniversary of the Commencement Date, through (b) the immediately following anniversary of the Commencement Date.

Contract Year. The twelve month period commencing on January 1 of each year and each successive twelve month period; provided, however, that the initial contract year shall be the period commencing on the Effective Date and ending on December 31,1998.

Contract Year. Shall mean (a) the period commencing on the Effective Date and ending on April 1, 2009 and (b) the twelve-month period ending on April 1 of each calendar year during the Term.

Contract Year. Of a particular Product means the twelve (12) month period beginning on the date of the First Commercial Sale of that Product to its customers and each twelve (12) month period thereafter beginning on the anniversary of such date.

Contract Year. Means one of any of the consecutive twelve (12) month periods during the Term, the first of which begins on the Effective Date.

Contract Year. Means each of the seven (7) periods of 365/366 days thereafter during the Term commencing on January 1. The period from July 1, 2010 through December 31, 2010 is not a Contract Year, in whole or in part.

Contract Year. Means each twelve (12) month period during the term of this Agreement beginning on the date of the commencement of commercial production of Daptomycin in the Facility. Preliminary activities related to Facility development, validation and product registration which occur in the period prior to the first Contract Year will be referred to as Year Zero.

Contract Year. Shall mean a period commencing on the first day of the month in which the Commencement Date occurs, and each anniversary thereof, and terminating on the last date of the month occurring one (1) year thereafter.
