Disability or Disabled. Disability or Disabled. A determination by independent competent medical authority (selected by the Board) in accordance with applicable law that Executive is unable to perform the essential functions of his job with or without an accommodation and such inability has continued, or with a reasonable medical likelihood such inability will continue, for a period in excess of 90 days, in the aggregate, in any 365-day period.
