First Commercial Sale. The first Sale of a Product by Licensee, Sublicensee or an Affiliate to any third party end user.
First Commercial Sale. Means, with respect to any Product, the first sale of such Licensed Product by Payor or an Affiliate or Sublicensee of Payor to a Third Party in the United States after such Product has been granted marketing approval by the FDA.
First Commercial Sale. The first sale of a Licensed Product by a Licensed Entity to an unaffiliated third party (as defined in Section 9.P.xi) for consideration after receipt of regulatory approval for the sale of such Licensed Product in the relevant jurisdiction.
First Commercial Sale. Shall mean with respect to any Licensed Product in the Territory, the first sale by INC or its Affiliates of any of the Licensed Products for use in the Field.
First Commercial Sale. Means the date of the first sale by Licensee, its Affiliate, a Sublicensee or an Affiliate of Sublicensee, of a Licensed Product to a third party for end use consumption of such Licensed Product and resulting in Net Sales.
First Commercial Sale. Shall mean on a country-by-country basis, with respect to any Licensed Product, the first sale of such Licensed Product under this Agreement to a Third Party in a country in the Territory, after such Licensed Product has been granted Regulatory Approval in such country.
First Commercial Sale. Of a Product means the first sale for use or consumption by the general public of such Product in a country after Marketing Approval and, if required for commercial sale, Price Approval, has been granted by the governing health authority of such country.
First Commercial Sale. The first commercial sale of any Product by Company or any of its Sublicensees or Affiliates following regulatory approval of such Product for the country in which the sale is to be made.
First Commercial Sale. Means, with respect to any Product, the first sale of such Product by LICENSEE or any of its Affiliates or Sublicensees to a Third Party for distribution, use or consumption in a country or jurisdiction in the Territory after Regulatory Approval for the commercial sale of such Product has been obtained in such country or jurisdiction.

Shall mean the first sale of an Oscine Product by Oscine, an Affiliate or a Permitted Transferee to an un-Affiliated third party after: (a) receipt of all governmental and other regulatory approvals required to market and sell Oscine Product have been obtained in the country in which such Oscine Product is sold, and (b) the commencement of marketing efforts with respect to such Oscine Product in the country in which such Oscine Product is sold.
