Shares

Shares. Shares of the Common Stock, any shares into which such Shares may be converted in accordance with Section 15 of the Plan and, to the extent a Participant would not become subject to the adverse tax consequences under Code Section 409A, such other securities or property as may become subject to Awards pursuant to this Plan

Shares. All shares of Stock now owned or hereafter acquired by any Company Stockholder or Investor and all other securities of the Corporation which may be issued in exchange for or in respect of such shares of Stock (whether by way of stock split, stock dividend, combination of shares, reclassification, recapitalization, reorganization or any other means)

Shares. Shall mean Common Shares and Preferred Shares.

Shares. Shall mean the shares listed on Schedule I hereto, now owned beneficially and of record by any Company, and all cash, dividends, other securities, instruments, rights (including voting rights, subject to the terms and conditions of this Security Agreement) and other property at any time and from time to time received or receivable in respect thereof or in exchange for all or any part thereof, and all proceeds of all of the foregoing.

Shares. Means the shares of Common Stock issued pursuant to the Merger Agreement as set forth on Appendix A.

Shares. The Company's class A common shares, $0.01 par value each, and any other equity securities of the Company that may be substituted or resubstituted for Shares pursuant to Section 11(c).

Shares. The term "Shares" shall mean shares of the Company's capital stock issued to investors in the Qualified Equity Financing.
