Software

Software. Shall mean the software and related items as described in EXHIBIT 2 and delivered to Customer under the Development Agreement and any Update.

Software. Shall mean Licensed Software and software (firmware) incorporated in hardware Products.

Software. The term "Software" shall mean the computer software programs of Paragon identified in Exhibit "A" attached hereto and incorporated herein in object code form only, and any versions of such programs which are provided to Licensee subsequent to the Effective Date (as defined below).

Software. Version 2.0 of the software component of the ISSANNI 1000 and all enhancements, modifications, upgrades, revisions, and derivative works thereto developed during the term of this Agreement. Such Software specifically includes Third Party Software.

Software. Means any and all computer/instrument software and/or firmware owned by or licensed to MASIMO that is used or useful in connection with MASIMO Technology for use in any Licensed Application and MASIMO Applications, including any and all future updates, revisions and Improvements thereto, all in source code and object code format, and all written documentation relating to such software.

Software. Means any and all computer/instrument software and/or firmware developed by MASIMO that is used or useful in connection with MASIMO Technology.

Software. Means all proprietary software applications written, designed, developed, sold or licensed by the Company and any translations or other derivative works based thereon or derived therefrom, including, without limitation those identified in Schedule 4.25 hereto.

Means any software, programming or computer code, including without limitation, the computer telephony integration ("CTI") software, staffing and scheduling software, call monitoring software and KANA email management software, owned by UPSTREAM or that are provided on behalf of or licensed and used by UPSTREAM in performance of the Services, along with all related documentation.
