Equipment

Equipment. Shall mean all of Borrower's (a) equipment, as defined in Chapter 1309 of the Ohio Revised Code as in effect from time to time, including without limitation, machinery, motor vehicles, trade fixtures, office and other furniture and furnishings; (b) goods that are used or bought for use primarily in Borrower's business; (c) goods that are not consumer goods, farm products (as defined in Chapter 1309 of the Ohio Revised Code as in effect from time to time), or Inventory; and (d) substitutes or... replacements for, and parts, accessories, additions, attachments, or accessions to (a) through (c) above; provided, however, that Equipment shall not include any equipment constituting part of the "Mortgaged Property" pursuant to the Open-End Shared Mortgage and Security Agreement dated as of January 1, 1988 between Borrower, as mortgagor, and The Director of Development of the State of Ohio, Bank of New York (as successor trustee), and PNC Bank, N.A. Equipment. Means all "equipment" (as defined in the UCC) now owned or hereafter acquired by Borrower, which Borrower acquired from Lender under the Supply Agreement or otherwise, including, without limitation, all machinery, computers, computer equipment, motor vehicles, trucks, trailers, vessels, aircraft, and rolling stock, and all parts thereof and all additions and accessions thereto and replacements therefor.

Equipment. Shall have the meaning provided in the paragraph entitled "Security".

Equipment. Means items of equipment capable of producing finished commercial Products from the mixing of Raw Materials through the packaging of finished Products in accordance with the applicable specifications.

Equipment. Means all Parts, materials and equipment, all whether now owned or hereafter acquired by Borrower and described in any Request for Advance and financed or refinanced with the proceeds of the Loan or any Advance and any and all additions thereto, substitutions and replacements of any of the foregoing, wherever located. Each item of Equipment is hereinafter referred to as an "Item of Equipment".
