Example Definitions of "Disability"
Disability. Shall exist for purposes of the Plan if a Participant is entitled to receive benefits under the applicable long-term disability program of the Company or an Affiliate of the Company, or, if no such program is in effect with respect to such Participant, if the Participant has become totally and permanently disabled within the meaning of Section 22(e)(3) of the Code.
Disability. Means total and permanent physical or mental impairment or sickness of a Participant, that is potentially permanent in character or that can be expected to last for a continuous period of not less than 12 months, making it impossible for the Participant to continue such Participant's employment with or service to the Company or Affiliate.
Disability. The meaning of such term as set forth in Section 409A of the Code. The Disability determination shall be in the sole discretion of the Board.
Disability. Executive is disabled for purposes of benefits under any long-term disability plan maintained by the Company Group in which Executive participates.
Disability. Unless otherwise defined in an employment agreement between the Participant and the Company, permanent and total disability within the meaning of Section 22(e)(3) of the Code.
Disability. Means that the Participant is permanently and totally disabled within the meaning of section 22(e)(3) of the Code.
Disability. The same meaning as set forth in your Letter Agreement dated February 24, 2021 as amended (the "Letter Agreement")
Disability. The meaning provided in the Company's long-term disability plan. If you are not eligible for the Company's long-term disability plan, any determination of disability shall be made by the Committee based on the definition of disability provided in the Company's long-term disability plan.
Disability. Or "Disabled" as it relates to an Eligible Individual means when such Eligible Individual (i) receives disability benefits under either Social Security or the applicable long- term disability plan of the Company or its Affiliates, if any, or (ii) the Administrator, upon the written report of a qualified physician designated by the Administrator or the insurer of the applicable long-term disability plan of the Company or its Affiliates, shall have determined (after a complete physical... examination of the Eligible Individual at any time after he has been absent from employment with the Company or its Affiliates for 90 or more consecutive calendar days) that such Eligible Individual has become physically and/or mentally incapable of performing such Eligible Individual's essential job functions with or without reasonable accommodation as required by law due to injury, illness, or other incapacity (physical or mental).
