Permanent Disability

Permanent Disability. Shall mean the inability of Executive to perform the services contemplated by Section 4 hereof for a period of at least one hundred eighty (180) consecutive calendar days or for thirty-five (35) weeks (whether or not consecutive) in anytwelve (12) month period on account of any sickness, injury or other infirmity or disability.

Permanent Disability. Means that the Board has determined in its good faith judgment that Executive is or will be unable to substantially perform his duties and responsibilities under this Agreement by reason of any physical or mental incapacity for a period of at least 60 consecutive days.

Permanent Disability. Means, with respect to a particular person, such person's incapacity due to physical or mental illness such that even with reasonable accommodation he or she is unable to perform the essential functions of his or her previously assigned duties where (i) such incapacity has been determined to exist by either (A) the Company's disability insurance carrier or (B) by the concurring opinions of two licensed physicians (one selected by the Company and one by Executive), and (ii) the Board has... determined, based on competent medical advice, that such incapacity will continue for such period of time of at least six continuous months and that it would have a material adverse effect on the Company. Permanent Disability. Shall mean a condition for which benefits would be payable under any long-term disability coverage (without regard to the application of any elimination period requirement) then provided to the Employee by the Bank or, if no such coverage is then being provided, the inability of the Employee to perform the material aspects of the Employee's duties under this Agreement for a period of at least 180 consecutive days as certified by a physician chosen by the Employee and reasonably acceptable to... the Employer. Permanent Disability. Means a mental incapacity or physical disability of --------------------- the Executive, rendering him unable to engage in his usual duties for a period of ninety (90) days or more, whether consecutive or not, within any twelve (12) consecutive month period, and shall be determined in good faith by the Board of Directors of the Company.

Permanent Disability. Any physical or mental disability which shall have rendered Executive unable to perform his duties hereunder for 120 consecutive days, or which, in the opinion of a licensed physician reasonably satisfactory to the company, is likely to render Executive unable to perform his duties hereunder for such 120 consecutive days period.

Permanent Disability. Of a Participant shall be deemed to have occurred when two medical doctors dealing at arm's length with the Corporation, EXCO and all the Participants deliver to the Corporation certificates stating that the Participant is disabled and by reason thereof cannot reasonably be expected to be able to continue performing for the Corporation for a period of at least 12 months the duties he performed before such disability;

Permanent Disability. Means a complete physical or mental inability, confirmed by a licensed physician, to perform the services described in Section 2 of the Agreement that continues for a period of six (6) consecutive months.

Permanent Disability. Shall mean if, as a result of the Executive's Disability, the Executive shall have been absent from his or her duties with the Employer on a full-time basis for six (6) months of any consecutive eight (8) month period.

Permanent Disability. Employee's inability to perform his or her stated duties with the Company by reason of illness, accident or other incapacity and inability to engage in any occupation or employment for wage or profit for which he or she is reasonably qualified by education, training, or experience, as determined by the Company in its sole discretion;
