Example Definitions of "Disability"
Disability. Or "Disabled" means, except as otherwise provided in this Plan, the Eligible Individual is unable to continue providing services by reason of any medically determinable physical or mental impairment which can be expected to result in death or can be expected to last for a continuous period of not less than twelve (12) months. For purposes of this Plan, the determination of Disability shall be made in the sole and absolute discretion of the Administrator.
Disability. The Executive's absence from the full-time performance of the Executive's duties (as such duties existed immediately prior to such absence) for 180 consecutive business days, when the Executive is disabled as a result of incapacity due to physical or mental illness
Disability. Shall mean a physical or mental illness that results in the Executive's absence from the full-time performance of his or her duties for 180 consecutive calendar days and within 30 days after the Notice of Termination is given to the Executive by the Company, the Executive shall not have returned to full-time performance of his or her duties.
Disability. Shall have the meaning ascribed to such term in the Participant's individual employment, severance or other agreement with the Company or, if the Participant is not party to such an agreement, "Disability" shall mean participant's inability because of ill health, physical or mental disability, to perform participant's duties for a period of 180 days in any twelve-month period.
Disability. The meaning as set forth in section 409A(a)(2)(C) of the Code.
Disability. Has the meaning set forth in the Equity Incentive Plan.
Disability. Shall mean the Key Employee's inability to substantially perform his or her employment duties, due to a medically determinable physical or mental illness or injury which lasts for, or is reasonably expected to last for, 60 consecutive days or 90 days in any 12-month period, whether or not consecutive. Disability. The same meaning ascribed to that term in Section 409A(a)(2)(C) of the Code
Disability. A Participant is unable to perform the duties of his or her customary position of employment by reason of any medically determinable physical or mental impairment that can be expected to result in death or that can be expected to last for a continuous period of not less than twelve (12) months. The Committee may require such medical or other evidence as it deems necessary to judge the nature and permanency of the Participant's condition.
Disability. Permanent and total disability as determined under the Company's or Affiliate's long-term disability plan applicable to the Participant, or if there is no such plan applicable to the Participant, the Participant's permanent and total disability within the meaning of Section 22(e)(3) of the Code.
