Disability. Disability. Any physical or mental condition which renders an employee incapable of performing the work for which such employee was employed by the Company or similar work offered by the Company. The Disability of an employee shall be established if (i) the employee satisfies the requirements for benefits under the Company’s long-term disability plan or (ii) if no long-term disability plan, the employee satisfies the requirements for Social Security disability benefits
Disability. If such Eligible Executive is entitled to receive long-term disability benefits under the Company’s disability plan or, if there is no such plan, such Eligible Executive’s inability to perform the essential functions of such Eligible Executive’s position (after accounting for reasonable accommodation, if applicable), due to an illness or physical or mental impairment or other incapacity that continues, or can reasonably be expected to continue, for a period in excess of one hundred twenty (120)... days, whether or not consecutive. Disability. For purposes of this Agreement, "Disability" means the inability of Executive, due to a physical or mental impairment, to perform the essential functions of the Executive's position, with or without reasonable accommodation, for a period of ninety (90) days. Shall mean the absence of Marchisello from Marchisello’s duties to the Company and/or TFOC on a full-time basis for a total of 16 consecutive weeks during any 12 month period as a result of incapacity due to mental or physical illness which is determined to be total and permanent by a physician selected by the Company and acceptable to Marchisello or Marchisello’s legal representative (such agreement as to acceptability not to be withheld unreasonably)
