Example Definitions of "Disability"
Disability. Shall be deemed the reason for the termination by the Company of the Executive's employment, if, (i) as a result of the Executive's incapacity due to physical or mental illness, fails to perform the essential functions of the Executive's position required of the Executive hereunder for a continuous period of 120 days or any 360 days during the Employment Period Term, and (ii) the Company shall have given the Executive a Notice of Termination for Disability.
Disability. The inability of a Grantee to perform the duties of the occupation at which a Grantee was employed when such disability commenced for a period of at least 120 consecutive days, or 180 non-consecutive days within any 365-day period, as determined by the Company in its discretion based upon medical evidence acceptable to it.
Disability. Shall mean, in the absence of any employment agreement between a Key Employee and the Company otherwise defining Disability, any physical or mental disability or infirmity that prevents the performance of a Key Employee's employment duties for a period of (i) ninety (90) consecutive days or (ii) one hundred twenty (120) non-consecutive days during any twelve (12) month period.
