Example Definitions of "Disability"
Disability. With respect to a Participant, such Participant's permanent and total disability within the meaning of the Company's long-term disability plan, as it may be amended from time to time, or, if there is no such plan, as determined by the Board.
Disability. That the Executive has suffered an incapacity due to physical or mental illness which meets the criteria for disability established at the time under Olin's short term disability plan.
Disability. Shall have the same meaning as in the Company's Severance Plan for Elected and Appointed Officers of Northrop Grumman Corporation
Disability. Such term as set forth in Section 409A of the Code.
Disability. Executive's full time absence from his duties with Newpark, as a result of incapacity due to physical or mental illness.
Disability. Shall mean a physical or mental impairment of sufficient severity such that a Participant is both eligible for and in receipt of benefits under the long-term disability provisions of the benefit plans of the Company or its Affiliates, as applicable.
Disability. Shall occur when the Board determines, upon the advice of an independent qualified physician selected by the Company, that Executive has become physically or mentally incapable of performing the essential functions of his job duties under this Agreement with or without reasonable accommodation, for ninety (90) consecutive days or one hundred twenty (120) nonconsecutive days in any twelve (12) month period. Disability. Shall be determined by a qualified independent physician selected by the Executive (or, if the Executive is unable to make such selection, it shall be made by any adult member of the Executive's immediate family), and approved by the Company, such approval not to be unreasonably withheld or delayed. The determination of such physician made in writing to the Company and to the Executive shall be final and conclusive for all purposes of this Agreement, absent fraud.
Disability. For purposes of this Agreement, "Disability" will mean Executive's absence from his responsibilities with the Company on a full-time basis for 120 calendar days in any consecutive twelve (12) months period as a result of Executive's mental or physical illness or injury. The Board will determine whether a Disability exists based on evidence provided by one or more physicians selected by the Board.
Disability. The term "Disability" shall mean a physical or mental incapacity that prevents the Executive from performing his duties hereunder for a period of one hundred eighty (180) consecutive days in any period of two consecutive fiscal years of the Company.
