Example Definitions of "Disability"
Disability. (a) that the Participant has been unable, by reason of illness or injury and with or without a reasonable accommodation, to perform his or her normal duties on behalf of the Company and its Affiliates for a period of 180 days, whether or not consecutive, within the preceding 360-day period; or (b) a condition whereby the Participant is eligible to receive disability benefits for permanent and total disability under any long-term disability plan of the Company or an Affiliate
Disability. The Executive's inability for medical reasons to perform the essential duties of the Executive's position for either ninety (90) consecutive calendar days or one hundred twenty (120) business days in a twelve (12) month period by reason of any medically determined physical or mental impairment as determined by a medical doctor selected by written agreement of the Company and the Executive upon the request of either party by notice to the other
Disability. The Employee shall be deemed to have a Disability for purposes of this Agreement if either (i) the Employee is deemed disabled for purposes of any group or individual disability policy or (ii) in the good faith judgment of the Board, the Employee is substantially unable to perform the Employee's duties under this Agreement for more than ninety (90) days, whether or not consecutive, in any twelve (12) month period, by reason of a physical or mental illness or injury.
Disability. A disability as determined by the Company's disability policy as in effect from time to time or as determined by the Administrator consistent therewith.

Disability. Strictly for the purpose of the parties' rights and obligations under this Agreement, means the Executive's inability, due to physical or mental impairment, to perform the essential functions of the Executive's position, with reasonable accommodation, for a period of one hundred and twenty (120) consecutive days or such other period of time as to which the parties may agree, as determined by a medical doctor selected by the Executive and the Company. Disability. For purposes of this Agreement, 'Disability' shall mean a physical or mental infirmity which the Company reasonably believes is expected to impair the Executive's ability to substantially perform the Executive's duties with the Company for a period of: (i) one hundred eighty (180) consecutive days; or (ii) 180 days during any twelve (12) month period, and the Executive has not returned to full time employment prior to the Termination Date as stated in the 'Notice of Termination'.
