Example Definitions of "Disability"
Disability. A physical or mental impairment which in the judgment of the Committee, based upon such information as may be reasonably available, from whatever source, including the results of a medical examination by a physician selected by the Committee, renders such Participant unable to engage in any substantial gainful activity and which impairment has lasted or can be expected to last for a continuous period of not less than twelve (12) months or can be expected to result in death
Disability. Executive's inability to perform the essential duties, responsibilities and functions of Executive's position with the Company and its Subsidiaries for any period totaling one hundred and eighty (180) days in any consecutive twelve (12) month period as a result of any mental or physical disability or incapacity, as determined under the definition of disability in the Company's long-term disability plan so as to qualify Executive for benefits under the terms of that plan or as determined by an... independent physician mutually selected by the Executive and the Company to the extent no such plan is then in effect. Disability. Disability means: (i) the Employee has been incapacitated by bodily injury, illness or disease so as to be prevented thereby from engaging in the performance of the Employee's duties; (ii) such total incapacity shall have continued for a period of six (6) consecutive months; and (iii) such incapacity will, in the opinion of a qualified physician selected by the Company, be permanent and continuous during the remainder of the Employee's life.
Disability. Disability. Except as otherwise determined by the Administrator and set forth in an Award agreement, any physical or mental impairment which qualifies Participant for disability benefits under the applicable long-term disability plan maintained by the Company or, if no such plan applies, which would qualify Participant for disability benefits under the Federal Social Security System.
