Example Definitions of "Disability"
Disability. Means a condition entitling Participant to long-term disability benefits under any policy, plan or program sponsored by the Company. In the absence of any such policy, plan or program, the term Disability has the meaning set forth in Section 22(e)(3) of the Internal Revenue Code. Notwithstanding the above, if necessary to comply with Section 409A of the Code, a Disability shall have the meaning set forth in Treasury Regulation Section 1.409A-3(i)(4).
Disability. For purposes of this Agreement, "Disability" means total and permanent disability as defined in Section 22(e)(3) of the Code.
Disability. A disability, whether temporary or permanent, partial or total, as determined by the Committee.
Disability. Shall occur if a Participant is incapacitated and absent from his or her duties on a full-time basis for 4 consecutive months or for at least 180 days (which need not be consecutive) during any 12 month period.
Disability. The illness or other mental or physical disability of the Executive, resulting in his failure to perform substantially his duties under this Agreement for a period of six or more consecutive months
Disability. Will mean your inability to perform substantially all of your duties for either one hundred twenty (120) consecutive calendar days or a total of one-hundred eighty (180) calendar days out of 365 consecutive calendar days as a result of a physical or mental illness, injury, disorder, or incapacity, all as determined in good faith by the Board of Directors and consistent with all applicable laws.
Disability. Disability as defined in a group long-term disability plan maintained by the Company as determined by the plan's claims fiduciary, or if no such plan is applicable, disability means Social Security disabled as determined by the Social Security Administration, provided, however, for Non-Employee Directors, disability means a disability as determined under procedures established by the Committee for purposes of this Plan.
Disability. Shall mean the inability of the Executive to perform his duties of employment for the Company, pursuant to the terms of this Agreement and by-laws of the Company as hereinafter provided, because of physical or mental disability, where such disability shall have existed for a period of more than 120 consecutive days or an aggregate of 180 days in 12 any 365 day period, and if a long-term disability plan is maintained by the Company for the benefit of the Executive, the Executive is entitled to... receive long term disability payments under a long term disability plan of the Company. The fact of whether or not a Disability exists hereunder shall be determined by appropriate medical experts selected by the Board. Disability. Unless the Administrator determines otherwise, has the meaning specified in the Company's or Cardinal Health's, as the case may be, long-term disability plan applicable to the Participant at the time of the disability
Disability. Any physical or mental disability or infirmity of Executive that prevents the performance of Executive's duties for a period of (i) one hundred twenty (120) consecutive days or (ii) one hundred eighty (180) non-consecutive days during any twelve (12) month period. Any question as to the existence, extent, or potentiality of Executive's Disability upon which Executive and the Company cannot agree shall be determined by a qualified, independent physician selected by the Company and approved by...
