Disabled. Shall mean a permanent and total disability within the meaning of Section 22(e)(3) of the Code

Disabled. Means, with respect to a Person, a court of competent jurisdiction has determined in a final non-appealable order that such Person is permanently and totally disabled and unable to engage in any substantial gainful activity by reason of a medically determinable physical or mental impairment that can be expected to result in death within 12 months, or which has lasted or can be expected to last for a continuous period of not less than 12 months.
Disabled. Means any physical or mental disability or infirmity that has prevented the performance of Executive's duties for a period of (i) one hundred twenty (120) consecutive days or (ii) one hundred eighty (180) non-consecutive days during any twelve (12) month period.
