Example Definitions of "Permanent Disability"
Permanent Disability. And "Permanently Disabled" mean that the Executive has a mental or physical infirmity which permanently impairs his ability to perform substantially his duties and responsibilities under this Agreement and which results in eligibility of the Executive under the long-term disability plan of the Bank.
Permanent Disability. Means an illness, accident or other condition which entitles Employee to benefits under a permanent disability program of the Company or an Affiliate.
Permanent Disability. Means, with respect to the Executive, that the Executive has become physically or mentally incapacitated or disabled so that, in the reasonable judgment of the Board, he is unable to perform the essential functions of his position under this Agreement, with or without reasonable accommodation, and such condition has continued for at least six consecutive calendar months or for 180 working days in any 12 month period.
Permanent Disability. Shall mean the Executive's inability to perform his normal duties and responsibilities for a period of more than six (6) months due to any physical or mental disability, illness, accident or condition.
Permanent Disability. Shall have the meaning set forth in the Participant's employment agreement with the Company or its Affiliates, if any, or if the Participant is not a party to an employment agreement with a definition of "Permanent Disability," then "Permanent Disability" means any physical or mental disability rendering the Participant unable to perform his duties for a period of at least one hundred twenty (120) days out of any twelve (12) month period.
Permanent Disability. For the purposes of this Agreement, the Executive shall be deemed to have incurred a "Permanent Disability" (i) if a physician engaged by the Executive certifies to the Company that the Executive is permanently and totally disabled, or (ii) if the Executive has been substantially unable, as a result of any physical or mental ailment, to perform his duties and responsibilities hereunder (A) for a period of three consecutive months or (B) on 80% or more of the working days during any five... consecutive months. Permanent Disability. Permanent Disability. Means "disability" as defined in Section 409A and Treasury Regulations promulgated thereunder:
Permanent Disability. The Optionee's permanent inability, due to illness, accident, injury, physical or mental incapacity or other disability, to carry out effectively his or her duties and obligations to the Company or to participate effectively and actively in the management of the Company, as determined in the reasonable judgment of the Board.
Permanent Disability. The status of disability determined conclusively by the Committee based upon certification of disability by the Social Security Administration or upon such other proof as the Committee may require, effective upon receipt of such certification or other proof by the Committee.
