Example Definitions of "Disability"
Disability. Means a physical or mental inability, confirmed by three (3) independent licensed physicians, to perform substantially all of the services described in Section 3 hereof that continues for a period of one hundred twenty (120) consecutive days.
Disability. Means any physical or mental illness or infirmity (which for the avoidance of doubt shall in any event be deemed for purposes of this Agreement to exclude habitual use of alcohol or drugs) of Executive that causes him to be substantially unable to perform his duties hereunder for any period of one hundred eighty (180) consecutive days or two hundred seventy (270) days, whether or not consecutive, in any period of three hundred sixty five (365) days, despite provision by the Company of... reasonable accommodations as required by law. The determination of whether a Disability exists shall be made by a licensed physician who is board certified in the applicable specialty selected by Company and Executive. If the parties cannot agree on such a physician or specialty, each party shall select a physician and the two physicians so selected shall select a third physician board certified in the specialty determined appropriate by the two physicians, and such board-certified physician shall make the determination of whether a Disability exists. Absent certification by the physician selected by the parties as aforesaid that the circumstances of Executive's condition have changed materially since the time of the then most recent determination, neither party shall be able to initiate a determination as to Disability for a period of nine months after the completion of the then most recent determination. Disability. The meaning ascribed to it in the Letter Agreement
Disability. Means (1) a "permanent and total disability" within the meaning of Section 22(e)(3) of the Code, or (2) the absence of the Grantee from his duties with the Company on a full-time basis for a period of nine months as a result of incapacity due to mental or physical illness which is determined to be total and permanent by a physician selected by the Company or its insurers and acceptable to the Grantee or his legal representative (such agreements as to acceptability not to be unreasonably... withheld). Disability. The Executive's total and permanent disability under the Company's long-term disability plan or policy applicable to the Executive such that the Executive becomes eligible to receive long-term disability benefits thereunder
Disability. The disability of Employee caused by any physical or mental injury, illness or incapacity as a result of which Employee is unable, with or without reasonable accommodation, to effectively perform the essential functions of Employee's duties for a continuous period of more than 180 days in any 365 day period, as determined by an independent licensed medical doctor, mutually agreed upon by Employee and the Company's Board of Directors.
