Example Definitions of "Disability"
Disability. Shall mean any medically determinable physical or mental impairment that, in the opinion of the Committee, based upon medical reports and other evidence satisfactory to the Committee, can reasonably be expected to prevent the Optionee from performing substantially all of his or her customary duties of employment (with or without reasonable accommodation) for a continuous period of not less than 12 months.
Disability. A disability which would qualify as such under Foot Locker's Long Term Disability Plan. Notwithstanding the foregoing, for Awards that are subject to Section 409A of the Code, Disability shall mean that a Participant is disabled within the meaning of Section 409A(a)(2)(C)(i) or (ii) of the Code.
Disability. Such incapacity due to physical or mental illness or injury as causes the Executive to be unable to perform the Executive's duties with the Corporation during 90 consecutive days or 120 days during any six month period.
Disability. The Executive no longer can perform one or more of the essential functions of the Executive's job even with reasonable accommodation and a physician selected by the Company has confirmed such condition exists and has reported his findings to the Company in a written notice received by the Company.
Disability. The Employee has been determined by the insurance company that insures the Company's group long-term disability program to be totally disabled. In the absence of such an insurance plan, the Committee may, in its sole discretion, determine that the Employee has a Disability if the Committee concludes that the Employee can no longer perform one or more of the essential functions of the Employee's job even with reasonable accommodation.
Disability. The absence of Officer from Officer's duties with the Company on a full time basis for 180 consecutive days as a result of Officer's incapacity due to physical or mental illness, unless, within 30 days after a Notice of Termination (as defined below) is given to Officer following such absence, Officer shall have returned to the full performance of Officer's duties.
Disability. The Participant has met the conditions to qualify for long-term disability benefits under the Company's policies, as in effect immediately prior to the Change of Control Date.
Disability. As determined by the Board in good faith, Executive's inability, due to disability or incapacity, to perform all of Executive's duties hereunder on a full-time basis for (i) periods aggregating one-hundred-eighty (180) days, whether or not continuous, in any continuous period of three-hundred-and-sixty-five (365) days or, (ii) where Executive's absence is adversely affecting the performance of Employer in a significant manner, periods greater than ninety (90) days and Executive is unable to... resume Executive's duties on a full time basis within ten (10) days of receipt of written notice of the Board's determination under this clause (ii). Disability. A permanent and total disability as defined in Section 422A(c)(7) of the Code
Disability. Your inability because of physical or mental incapacity to perform your usual duties at the Company for a period of one hundred eighty (180) days in any consecutive twelve (12) month period.
